Important Legal Notice - Use of ACG Systems

Only authorized users are allowed

By accessing or using any AAA Auto Club Group (“ACG”) system, including but not limited to platforms (for example, the Customer Relationship Management system), collaboration tools, shared drives, operational systems, and/or internal applications, regardless of whether access is initiated via a device owned by you, ACG or a third party, you agree to the following terms:

Authorized Use

ACG provides you access to systems for official company business only. Any devices attached to this computer and the information systems accessed from this point forward contain information which is confidential to ACG. The information systems, and all data and communications generated, stored, or transmitted on it, are the property of The Auto Club Group. Your activities and use of these are monitored and may be recorded which includes user inputs, uploads, downloads, system interactions, and behavioral patterns. Metadata, such as login history, file access, and system usage, is recorded and utilized by ACG without limitation. By using this system, you acknowledge and consent to the following:

• You have no expectation of privacy regarding any meeting, communication, or activity on this system, whether using company-owned or personal devices.
• All use of this system(s), including but not limited to virtual and in-person meetings, phone calls, email, instant messages, may be monitored, intercepted, reviewed, recorded, copied, transcribed and stored by The Auto Club Group.
• Monitoring, recording and transcription may be done with or without additional prior notice.
• Data may be used for a variety of legitimate business purposes, including but not limited to:
  • Quality assurance and service improvement
  • Training and coaching
  • Ensuring compliance with corporate policies and other legal obligations
  • System security and network maintenance
  • Investigating potential misconduct or violations of company policy
• Any unauthorized use of this system is prohibited and may result in disciplinary action, including termination of employment.

If you do not agree to these conditions, you must log off and refrain from using this system. Your continued use of this system constitutes your consent.

Retention and Use of System-Contributed Content - Any content entered, uploaded, generated, or shared within ACG systems may be retained, duplicated, modified, and used by ACG for any lawful purpose, including operational, legal, commercial, and strategic initiatives.
Waiver of Intellectual Property and Attribution Rights - You waive all rights to ownership of intellectual property, attribution, compensation, and usage related to any content created, contributed, shared, accessed and/or manipulated by you via ACG systems. You agree that, as between you and ACG, ACG shall retain exclusive, perpetual ownership of all system-generated outputs and derivative works.
ACG employees only : Use During Non-Working hours and Overtime - Non-Exempt employees must obtain authorization from leadership before using company systems and applications during non-working hours. Non-Exempt employees (employees who are paid an hourly wage and are eligible for overtime pay- See ACG Employment Policy Guide) must report all hours worked, including time worked on behalf of ACG outside of their scheduled work hours. Any time spent using an ACG system must be reported as hours worked in the designated timekeeping system. Working "off the clock" is prohibited. Using this application without authorization, or for unauthorized purposes, is strictly prohibited. This application is available to active employees only.
Third party system users only - Any third-party vendor, consultant, contractor or agent (“Supplier”) and the personnel employed and assigned by the vendor, consultant, contractor or agent (“ Authorized User”) who have been authorized by ACG to use any ACG system is subject to these terms in addition to the terms and conditions set forth in the Third Party Systems User Access Agreement.
Authorized Users - ACG systems and applications are available to active ACG employees and non-employees who have been authorized by ACG and issued access credentials only. Use by others is strictly prohibited.
Scope - These provisions apply universally across all ACG systems and platforms unless explicitly superseded by a written agreement executed by ACG.
Presumed Consent /Default Acceptance - If you do not consent to these terms, you must refrain from using ACG systems and notify your direct manager immediately. Continued use shall constitute irrevocable acceptance of these terms.
